How long do i have to live in the UK (specifically london) to be eligible to apply for a permanent residency?

i'm currently on a student visa and have been living in london (specifically camden town ;D) for 10 months. My visa expires in 2010 but i cannot stop attending classes and work full time without HO's permission. How do i go about getting that.



i have been offered a job as an ESOL tutor, and that is my main reason for wanting to change my status.



i'v heard from people that i need to live in the UK for a year to apply for a %26quot;leave to remain%26quot;? (did i just answer my question?)

no that is why it is a law, you have to change your adress within 90 days of moving, or you can get a ticket for that but it is not roughly enforced. Just don't get caught

Hi, I am mexican and my husband is american. we just got married and we are applying for my change of status to become a permanent recident (I hold a F-1 visa).

if we send all the documents by the end of next week (2nd week of September), when would I be able to leave the country and reenter to USA?

The thing is that our religious wedding and reception is planned to be in Mexico in January 16... would we make it on time for me to eb able to leave the USA and come back? I heard is 90 days, is it true?

I don't think it would be a good idea to travel outside the US until you physically have your green card in hand....if you leave the country you have the posiblity of getting a ban placed on you and not being able to return. The I-130 usually takes about 6 months to a year to process..depending on what field office it goes too..vermont takes the longest. And then you would have to file your AOS paperwork..so I don't think you will make it by Jan. 16. Sorry! Best of luck to you!

Along with the residence applications to enable you to travel while they are pending you should also submit

form I-131 which is the travel document application.Follow the instructions for Advance Parole. See uscis.gov for it

I am here in the US with F-1 student visa. My husband (US citizen)and I just got married in Sept '08 and we are applying for a permanent residence this week. My F-1 visa will be terminated this week because I am applying for change of status. However my concern is that we have already set a wedding ceremony date on June '09. This is not a problem. As you are here in the USA (Legally) you can file the I 130 (Petition for Alien Relative) and I 485 (Adjustment of Status forms together) When you file these forms you can also file (at no additional charge) in I 131 (Travel Permission/Advance Parole request) and I 765 (Employment authorization) Like I said it doesn't cost you anything, they are free when you pay the filing fee for the I 485. I filed all of my paperwork (with a lawyer) almost a year ago, Dec 7th 2007. I got my advance parole and employment authorization at the end of Jan 2008 so I was able to travel at that point and go into any job I wished. I had my green card interview April 7th 2008 and had my physical green card in the mail 3 weeks later. So from filing to having my green card it took just over 4 months. If you are filing now, and don't have to go anywhere for at least 6 months you should be fine, particularly if you file the advance parole form and state on there the dates you need to travel. In fact I would tell them you need to travel by say March 08 that way you can make sure you have travel permission by then at least. If you need any help with forms etc let me know, I have scanned copies of all my forms. Good luck.

It can take almost a year. It always depends on the center itself. I would hold off on a ceremony abroad until you get a clearer idea of how fast they are processing. I filed in March of 08 and I'm still waiting. Good luck.
File an I-131 application for travel document if you want to leave the country and return. You want an advanced parole (this form has multiple uses).
The only thin you can do is file a form I 131 for travel permit . In this way you will be allowed to reentry the USA .

I think that you will file a I 765 with your I 485, if that is the case you will have your EAD and with that and the permit is going to be fine.

Go to www.uscis.gov , download the form and the intructions, and mail it asap .

I got back in the US February 14th 2009 and i entered the country with my tourist visa. If we get married, fill out and send all this forms below will things work out? or will they deny me because i entered the country as a tourist?

Do not marry on a B-2 visa (and overstay) as it may jeopardize your chances of being petitioned. Do it the right way. If you marry now, you have to go back to your country and wait for the petition to be approved (K-3). OR Go home and let him do the petition for a fiancee visa. Both have the same time period for processing. Varies from 8-12 months depending on the load of the embassy. At least, if it is a fiancee visa, when you finally get married, you just have to adjust your status. No need of going back to your country.

I think you will be perfectly okay. My husband entered on a tourist visa also and that process is exactly what we did. It took us a total of six months until he had his greencard in his hands. Do not file I-130/I-485 or marry until after May 15th otherwise you'll have to deal with presumption of dual intent - ie visa fraud. After 90 days the presumption is no longer there. You also need to send photos, medical examination and copies of supporting documents (take originals with you to interview) Please see an AILA immgiration attorney to help you. It does not appear that you know what to do, you'll mess up and then you'll have to pay the lawyer 3 times as much to clean up the mess.

    First, you can hardly be a dependent of someone with whom you don't even live...especially when you DO live with your parents!! Second, in both Wisconsin and Florida, you are an adult. You don't need a guardian and I can hardly imagine any circumstances that apply to you under which a court would grant another adult guardianship of you. You are not in any way disabled - you basically just want to cheat some Florida college out of their out-of-state tuition.



    Also, remember that just living in Florida (or most any state) for a year does not automatically qualify you for in-state tuition. The language from both the University of Florida and Florida State's policies apparently quotes the state law: %26quot;Living in or attending school in Florida will not, in itself, establish legal residence for tuition purposes.%26quot;

    I believe ur aunt and u would have to tag-team to get any of that done. I believe u'd have to go along with her to the local DMV and inform a representative that you now live in Florida amongst ur aunt. Of course, she'd have to verify that she's a Floridian (utility bill, driv. license, stuff like that may help). Pay the fee 4 the new drivers license and badabing, ur officially a Floridian resident again. From there, the rest of the things that u want oughta not be hard to get so long as u have the common know-how of getting them. They're basically the same through the states. Matter of fact, even if you don't have the common know-how, they oughta be easy to get. :-)

    I don't think that condominium thing has any affect regarding reverting ur residency.

    These are all medical careers I'm thinking about.     Dermatology is the toughest residency to get. Dermatologists also have to do skin surgery. The best residency for you is probably internal medicine or family practice which are easy to get. I think you need to do an internal medicine residency before doing a dermatology one anyway.

    Please be cautious if taking this approach; note the skepticism of many of the persons who posted on the thread at the Student Doctor forums. Also, please note that you would still have to pass the USMLEs and get into a US residency, which may be hard to do with an MD from a Caribbean school.

    Texas gave joint custody to my childs father giving him the right to residency . He lives in Florida I was living in Texas with my daughter at the time. Four years later I got a hjob with a company that I was able to transfer to there office in Florida and We all now live here . I have lived here now for 3 years , I tried to change venue but the courts here told me Texas wont relinquish jurisdiction. What am I suposted to do now I have another child and He had me paying childsuport on an income I can prove I never came close to ever making.

    If you got divorced in Texas, that court is going to retain jurisdiction until the child is 18 years old. A FEDERAL LAW, the 1994 Child Custody Act, prevents parents from being able to move to another state with their children without the permission of the other parent or the Court of Original jurisdiction. Unfortunately, it also prevents Texas from %26quot;ceding%26quot; jurisdiction over Custodial and Child Support issues to another state- even with the permission of the parties!

    You could file a motion for Modification of Child Support in TEXAS, and hope the Judge would consider that Texas TECHNICALLY does not have, %26quot;a dog in the hunt%26quot;, anymore, but he likely will NOT change anything but the AMOUNT. Think about it; all you'd have to do is move back to Texas, and the whole process would have to start over again! The Law does NOT like people to be %26quot;playing%26quot; those kinds of games (the way the COURT would see it!)

    You can go back and correct a FAFSA to update financial info. The school may flag this and ask you to verify your info. Be prepared to prove that you live with your father and not your mother and that he is claiming you for tax purposes and not your mother.

    Since it is mid-year your aid is already determined but I would advise you to go the financial aid office of your school and seek in-person advice.

    On the day you filled out your fafsa, it was your mom that provided the most support to you and the one who you were suppose to report. This information can not be updated because it was (and still is) the correct information by looking at the date you filled out the fafsa.



    You can't change it mid year. If you want to try to use your Dads (and step mom if you have one) on your next fafsa, you can try, but this is rarely successful. The fin aid office can see your old fafsa with mom making 100K a year and will question you.



    If if makes you feel any better, you prob won't qualify for grants with dads income either.

    I got married a year ago and we are about to apply for a change of status from my f-1 to legal resident. However, I don't want to have to have my maiden name registered on the green card etc and then have to go through and pay to have it changed so I would rather do it now. Am I able to change the name on the visa in my passport? If so how? If not, can I fill out my residency application with my name with my married name and 'other' being my maiden name, still? Someone please help this is so frustrating as there is no solid information out there and application fees are enough without having to pay for a lawyer (which I can't afford).

However, I'm legally a resident right now with my father's business visa (E2). I'm currently a sophomore, and I would like to go to an American college, like the University of Washington. However, after I become 21, I'd have to change my visa to a student visa, which will cost my family a fortune-- and we do not have that kind of money.     The system is either:



    Marry a US citizen over 21 years old and making over $30,000 per year.



    Get an F-1 student visa and go to college, get a job for a year under OPT, have the employer get you an H-1B during that year, if one is available. Then once youhave the H-1B the employer can apply for a green card for you. With a bachelor's degree, expect the green card to take about 7 to 9 years after they apply for it.





    The catch is that you cannot get any US student aid when in college. And once you start college you have to transfer to an F-1 visa. You have to pay full international student rates. And until you have your degree you car not skilled enough to qualify for an employment based green card.

    I have two kids with my husband. He is Verbally abusive, which I can't prove. I have no family here in Az. Turns out if I file for divorce I have to keep the kids here.     To be divorced in most states you have to be a resident there for six months. You can live in any state and get divorced as long as you are a resident. You do not have to file in the state that you were married in. I was married in Ohio but divorced in Georgia. It really doesn't matter what anyone thinks about your situation.     that's a tough one. i think you have to get divorced in the state in which you were married. not really sure. i know i did.
    You can only file in the state in which you have established legal residency whether you physically stay there. Now if you go thru the divorce in Arizona, the courts should award you custody of your kids barring any legal trouble like child and/or drug/mental abuse that would make you unfit. Then youd get child upport and most likely the house due to the kids and the Judge will not put you and the kids out on the street. You then get a order to vacate premises for him so you can stillcome out ahead there. You can petition the court then to relocate the kids back to Florida due to family if dad wont agree and get the Judges permission. Now you can have a bargaining chip here in the house, you could let him have the house in return for his permission to let you move with the kids to here. Youll have to come up with a plan to satisfy dads visitation rights before the Judge will approve but youll come up with something. Also Arizon will get the divorce over quicker than trying to re-establish residency back here. Emotinal/verbalabuse is the hardest abuse to prove but if you have any witnesses or whatever, itll be a big help to you in court.     The requirement to file for divorce in Florida is 6 months of established residency. Therefore, you would be required to prove to the court that you have lived in Florida for those six months immediately prior to filing.



    In that six months your husband can file for divorce in Arizona and the court can order the children returned to the jurisdiction (you do not have to return). If you fail to return the children, and while there is a current action in the family court, you can be charged with parental abduction which, because you are in a different state, rises to the level of a federal offense.



    Therefore, you MUST file in Arizona or face the above scenario.



    Also, there is no way ANYONE can tell you that you will receive custody. That is not only irresponsible but based ONLY on your facts, something even your attorney sitting face to face with you will not tell you.



    You make a good case but the court will require that you (and your husband) prove your allegations otherwise, according to Arizona Rules of Civil Procedure, joint custody is the norm.



    Also, if you then do obtain permission to move the children and yourself to florida, it is likely the court will require that YOU pay for transportation expenses to allow your ex to exercise his visitation based on the fact that you created the distance.



    And, as long as the ex lives in Arizona, jurisdiction, according to the UCCJA, will remain in Arizona so that every hearing in the future related to the case will be heard in that state.

    I'm not sure how it works but don't let her move in with you if it means you won't be able to complete your studies! You're under no obligation to support her after only a year, and to your own detriment.

    I live in my parents house in PA, i just got out of the military and plan on attending a school in Ohio. I am eligible for immediate residency and obtain the in state tuition in OH for being a veteran. my question is, i have an off campus apartment which only lasts six months then i have to find another apt after that, so does this mean that since i use this address i have to change my drivers license, insurance, vehicle registration etc or can i just use this address for the school and keep my residency status in PA which i have a DL, ID, vehicle registration, insurance etc? the school only wants the lease, my discharge papers, and a state ID, my other question is how can i obtain a state ID while not officially move to ohio? thanks in advance!

    You can only be a resident of one state...and that state is where you are required to have all your ID's, registrations, etc...but if you are a student in another state, you are not required to change anything over to the home state of the school

    I am a student in central/southern California. I used to live in northern California with my parents but moved down here with my gf. I am renting a studio, but do not pay utilities. For our anniversary i am taking us both to Disneyland. They offer tickets for Southern California residents at a very good discount. How do i prove my Residency here. I am in the proper zip code for the discount. I do have mail address here, but my ID, Bank account, Car and other documents are all registered to my Northern California home. *i do not want to change my address to here, because i will be moving out in October*.     Not aware that Disneyland offered ONE day tickets at a discount to local residents. I know they offer a season pass to Socal residents, but these passes have lots of blackout dates, including most of the summer, and all Saturdays.



    Cuesta College in SLO is too far away to count as a local resident; there are specific zip codes to get the pass.

    If your family lives there and you are going to school in florida, then your permanent address can be your parents address legally. You should have no difficulties. However, if you do not have a physical address which you are in some way attached to(can receive mail at) then you cannot form residency.



    *edit: if the only reason you moved to florida would be to be in school then technically you are still a resident of Mass. Most out of state students get licenses mail cellphones cars and those type of things in the state they are attending school, however schools only consider you an in state resident if you have been in the state for at least one year, and if you do not just reside in the state for educational purposes.

    Okay so I am still trying to finish off highschool and have beautiful baby boy. Who I wouldn't take back for anything and is my world. Getting pregnant really changed me. Like literally saved my life, I was always slacking off in school, getting bad grades, never caring about the future, being fake and doing what everyone else was doing. But after I got pregnant I realized i needed to change be better, do better, and start being the person God created me to be. So I found a new dream.     I think you should follow your dreams. Go to med school. Your son will still be there, and your family will be more than happy to help you. If you can provide for him, a couple years of seeing him less is worth it.

    It is possible, if you leave him at your parents house while your gone etc, money shouldnt be a problem really, its jsut mentally. Your going to get stressed, your going to get tired. Your not going to be able to play with him as much. But really itl all be worth it for you and him.
    He will not be 2 when you start med school.Before med school you have to get an underdgad degree so at least 4 years after high school before you can start med school. So 4 years for your degree, 4 years for med school, 4 years for residency and then about another 6 years for your specialty.

    I'm over 18. I lived in Massachusetts a while go, as a kid. My parents split up, and we went to NH. I've been a resident of NH for about 5 or 6 years now. I've have my lisc. and a car since September 2008.



    My dad lives in MA still and so I'll be moving in with him. I've got a few questions about becoming a resident.



    How much does it cost to convert a regular ol' Driver's Lisc. from NH to MA. On the website it says $125, but there are other fees below it. Are these also needed (they're about driving records and such) to be paid when converting your lisc. over?



    For registering a car, how much is it? How about inspection? I've got a '95 Ford Taurus if that helps.



    What's the deal on insurance? My mom, who lives in NH, has the insurance policy that my car is on. If I switch to an MA residency, do I have to change my insurance somehow and/or get my own?



    Last: Marriage question! If I want to get married to someone who lives in NH, do they need to become a resident of MA? What fees are there, in general?

    I have come to the U.S. as a F1 student on January 7, 2010. The classes started yesterday. I don't really want to study now and besides I am running out of money and now I am seeking any options to obtain work permit.



    the question is: can I change my F1 status to J1 now? if yes, how? and what time does it take? what are the consequences? does J1 status give work authorization? and how can I obtain J1 without 2 year residency rule ?

    Theoretically you can change, but do you have an university which is willing to sponsor the J1 and pay you? I am not sure if you can change within the country or if you would have to leave, but your international student office should be able to tell you.



    If not you have to keep in mind that you lose your F1 status if you don't go to classes or if you fail all of them.



    If you run out of money before even classes start how come you got an F1? You needed to show sufficient funds didn't you? Where are they?



    Unless somebody offers you a position (e.g. postdoctoral position) I don't think you have much chances for a J1. Also you aren't allowed to work for a different employer than the educational institution which sponsors you.

    I mean yes techincally you can do that, but they will recognize you moved just for the difference in tuition. If you are applying for financial aid they'll need all of the information as far as where you lived, esp. if you recently moved.



    If you are 18 you don't need to change the legal guardianship from your parent to your aunt. You just need to change your address to there. Change your ID and forward all your mail to her address.

    I am the custodial parent and I moved from Indiana to Mississippi.

    According to my original papers It states that I have to follow the guidelines set up in Indiana no matter where moved to. That Indiana rules applies to all of my child support and visitation guidelines. So unless your papers stated something different than mine then you would have to follow the same rules as you had orginially. I am not sure if you could go back to court in the new state and have them changed. You could contact the child support department of your court that set up your child support payments before you move they would more than likely give you the legal details. I also suggest you contact the attorney that handled your case if you had one. That attorney is the attorney of record they have a legal obligation to give you advice on the matter since they in the eyes of the court are your attorney on record. hope that helps. But each case has special guidelines and special circumstances. I would go threw your papers.
    As far as I know the Child Support Payments are set up according to the state that the divorce and the Child Support was orginally set.



    Child Support Guidlines change often, and I dont know the state that you live, asumming that you live in the US.

    I am a full time student. I qualified for 3,500 in federal loans. However my school is saying that I missed the deadline for federal aid because I was not enrolled as full time on that fate.     Im a temporary foreign worker in alberta, canada and I came here as single. the company I work with is kind enough to help me apply for a permanent residency here. now my fiancee and I are planning to get married, he鈥檚 from australia and were planning to get married there. Will there be complications when I marry before applying for permanent residency since I apply here as single? how will the change of status from single to married go, what are the documents to update. Can I still use my maiden name in my documents but attach my marriage certificate and declare married in my status? How long will the process go?

    YES there would be complications if you married before your PR application is complete.



    if you were to get married while the PR application is in process - the delay may be many months - particularly since he is not canadian and he is not eligible to get PR based on your application - he needs to apply for himself based on his work permit



    you must be a PR first before you can get married and apply for the spouse



    I strongly suggest that you do NOT get married until after you get your PR status (as a single) - otherwise you could create a LOT of problems for you and your spouse.

    You are a conditional permanent resident, this really is no different from being a non-conditional permanent resident except of course having the two-year green card as opposed to a 10 year.



    You will file for those condition to be removed by filing Form I-751 at anytime during the 90 day period before your conditional green card expires.



    Being married for 1.5 years make no difference, it is how long you was married for at the time of filing. If you filed after you had been married for two years, you would have received a 10 year green card.



    You can file for citizenship upon the third anniversity of obtaining your green card.
